ବ୍ରହ୍ମପୁର,୩୦/୧୧/୨୦୨୨: ସୂଚନା ଅଧିକାର କର୍ମୀ ବିଶ୍ବମ୍ବର ପାତଙ୍କୁ ବ୍ଳକ ପରିସରରୁ ଅପହରଣ ଘଟଣା ରେ ଜାତୀୟ ମାନବାଧିକାର କମିଶନ ଦିଲ୍ଲୀ ତରଫରୁ ବ୍ରହ୍ମପୁର ଏସପିଙ୍କୁ ପୁନଃ ନୋଟିସ ସହ ତାଗିଦ୍ ହୋଇଥିବା ଜଣାପଡିଛି ।ସୂଚନାଯୋଗ୍ୟ ଗତ ସେପ୍ଟେମ୍ବର ୧୯ ତାରିଖରେ ବିଶ୍ବମ୍ବର ପାତ୍ର ନାମକ ଜଣେ ସୂଚନା ଅଧିକାର କର୍ମୀ ଏକ ସୂଚନା ଅଧିକାର ବିଷୟରେ ବିଡ଼ିଓଙ୍କ ଡାକରା ଅନୁଯାୟୀ ପ୍ରଥମ ଅପିଲର ଶୁଣାଣି ପାଇଁ ଯାଇଥିଲେ । ସେହି ସମୟରେ ବିଡ଼ିଓଙ୍କ ପ୍ରରୋଚନା ଓ ଇଙ୍ଗିତରେ କୁସୁମୀ ଡବଲ୍ ମର୍ଡର ଘଟଣାରେ ଆଜୀବନ କାରାଦଣ୍ଡ ଭୋଗୁଥାଇ ମାନ୍ୟବର ଉଚ୍ଚ ନ୍ୟାୟାଳୟରୁ ଅପିଲ୍ ଜାମିନରେ ଥିବା ସି.ଏଚ. ବାଇରୀ ପାତ୍ର ନାମକ ଜଣେ କୂଖ୍ୟାତ ଅପରାଧୀ ସ୍ପଷ୍ଟ ଦିବାଲୋକରେ ବିଡ଼ିଓଙ୍କ ଉପସ୍ଥିତିରେ ତାର କିଛି ସହଯୋଗିଙ୍କ ସହିତ ବ୍ଳକ ପରିସରରୁ ଅପହରଣ କରି ନେଇ ଜୀବନରେ ମାରିଦେବା ପାଇଁ ଉଦ୍ୟମ କରିଥିଲେ ସେହି ସମୟରେ ବାଇରୀ ପାତ୍ର ଓ ତାଙ୍କ ସହଯୋଗୀଙ୍କ ବିରୋଧରେ ଗୋଳନଥରା ଥାନାରେ ଏତଲା ନମ୍ବର ୩୪୦/୨୦୨୨ ରେ ଏକ କେସ୍ ରୁଜୁ କରାଯାଇଥିଲା । ମାତ୍ର ବାଇରୀ ପାତ୍ର ଜଣେ ସରକାରୀ ଦଳର ସ୍ଥାନୀୟ ନେତା, ବାହୁବଳୀ ଓ ଧନଶାଳୀ ବ୍ୟକ୍ତି ବିଶେଷ ହୋଇଥିବା ଯୋଗୁଁ, କୈାଣସି ନା କୋୖଣସି ଅଦୃଶ୍ୟ ଚାପର ବଶବର୍ତ୍ତୀ ହୋଇ ପୋଲିସ ପକ୍ଷରୁ ଗିରଫ କରାଯାଇନଥିଲା ଓ ସମସ୍ତ ଅଭିଯୁକ୍ତ ଉଚ୍ଚ ନ୍ୟାୟାଳୟରୁ ଜାମିନ ପାଇବାରେ ସକ୍ଷମ ହୋଇଥିଲେ । ତେଣୁ ଏହି ଘଟଣାରେ କଟକ ଜିଲ୍ଲାର ଶ୍ରୀମାନ ଭଜମନ ବିଶ୍ବାଳ ନାମକ ଜଣେ ମାନବାଧିକାର ରକ୍ଷକ ଦିଲ୍ଲୀ ସ୍ଥିତ ଜାତୀୟ ମାନବାଧିକାର କମିଶନଙ୍କ ନିକଟରେ ଏକ ଅଭିଯୋଗ ପତ୍ର ଦାଖଲ କରିଥିଲେ । ଏହି ଅଭିଯୋଗର ଗୁରୁତ୍ତ୍ଵକୁ ଉପଲବ୍ଧି କରି ଗତ ଅକ୍ଟୋବର ମାସ ୧୦ ତାରିଖରେ ମାନ୍ୟବର କମିଶନ କେସ୍ ନମ୍ବର ୩୭୦୩/୧୮/୨୨/୨୦୨୨ ଶୁଣାଣି କରି ଆସନ୍ତା ଚାରି ସପ୍ତାହ ମଧ୍ୟରେ ରିପୋର୍ଟ ଦାଖଲ କରିବା ପାଇଁ ନିର୍ଦ୍ଦେଶ ଦେଇଥିଲେ । ମାତ୍ର ଦୁଃଖର କଥା, ଏହି ଧାର୍ଯ୍ୟ ସମୟ ଅବଧି ମଧ୍ୟରେ ବ୍ରହ୍ମପୁର ଏସପି କୋୖଣସି ରିପୋର୍ଟ ଦାଖଲ କରିନଥିଲେ ।
ମାନ୍ୟବର କମିଶନ ପୁଣି ନଭେମ୍ବର ମାସ ୨୮ ତାରିଖରେ ଉକ୍ତ କେସକୁ ଶୁଣାଣି ସମୟରେ ରିପୋର୍ଟ ଦାଖଲ ହୋଇନଥିବା ଜାଣି ବିରକ୍ତି ପ୍ରକାଶ କରି ପୁଣି ଆସନ୍ତା ଚାରି ସପ୍ତାହ ମଧ୍ୟରେ ରିପୋର୍ଟ ଦାଖଲ କରିବା ପାଇଁ ନିର୍ଦ୍ଦେଶ ଜାରି କରିଛନ୍ତି । ଏହାବ୍ୟତୀତ, ଯଦି ଧାର୍ଯ୍ୟ ସମୟ ଅବଧି ମଧ୍ୟରେ ରିପୋର୍ଟ ଦାଖଲ ନ କରନ୍ତି ତେବେ କମିଶନଙ୍କ ଅଧିକୃତ କ୍ଷମତା u/s PHR Act 1993 ବଳରେ ଏସପି ବ୍ୟକ୍ତିଗତ ଭାବେ ହାଜର ହୋଇ ରିପୋର୍ଟ ଦାଖଲ କରିବା ପାଇଁ ନିର୍ଦ୍ଦେଶ ଜାରି କରିବା ପାଇଁ ବାଧ୍ୟ ହେବେ ବୋଲି ଆଦେଶ ଜାରି କରିବା ସହିତ ପୋଲିସ ମହାନିର୍ଦ୍ଦେଶକ (ଓଡ଼ିଶା)ଙ୍କୁ ମଧ୍ୟ ଆଦେଶ ପତ୍ର ପ୍ରେରିତ କରିଛନ୍ତି ।

Sir/Madam,
The complaint/intimation dated 06/10/2022, was placed before the Commission on 28/11/2022. Upon perusing the same, the Commission directed as follows:
Instant complaint is regarding allegations of abduction of one HRD and RTI Activist Sh. Biswambar Patro by goons on 19.9.2022 from the premises of Rangeilunda Block in Berhampur, Odisha who was later on mercilessly beaten by goons with an intent to murder him. It is further alleged that through an FIR No. 340/2022 was registered but no action has been taken by police to arrest the accused who are roaming freely rather a frivolous FIR has been registered against the victim on complaint of accused persons. Hence, seeking intervention of the Commission.
The Commission took cognizance on 10/10/2022 and directed its Registry to transmit a copy of the complaint to the Superintendent of Police, Berhampur, Odisha calling for an action taken report within four weeks.
The Commission observes that in the instant case despite direction, the said authority has not submitted any report till date.
The Commission directs its registry to retransmit the copy of the complaint and the last direction of the Commission to the Superintendent of Police, Berhampur, Odisha for submission of requisite report within four weeks failing which the Commission shall be constrained to invoke its coercive power u/s 13 of the PHR Act,1993 calling for the personal appearance of the authority concerned before the Commission.
The copy of instant proceeding be forwarded to the Director General of Police, Odisha for information and ensuring compliance of direction of the Commission by aforesaid authority.
2. Accordingly, I am forwarding herewith a copy of the complaint/intimation as an attachment for taking appropriate action in the matter as per the directions of the Commission. It is requested that an Action Taken Report be sent to the Commission within 4 weeks from the date of receipt of this letter.
3. Any communication by public authorities in this matter may please be sent to the Commission through the HRCNet Portal (https://hrcnet.nic.in) by using id and password already provided to the public authorities (click Authority Login), or through Speed Post/ at email-id cr.nhrc@nic.in. Any Audio/ Video CDs/ pen drives etc. and bulky reports may be sent through Speed Post/ per bearer.
